These Terms of Service ("Terms") govern your use of the Undesk mobile app and related services (the "App"), provided by Jakub Nowacki, running a sole proprietorship under the name SwiftIT Nowacki Jakub, ul. Ks. Kazimierza Ciuby 14, 43-600 Jaworzno, Poland, tax ID (NIP) 6322036596, REGON 527957448, registered in CEIDG ("we", "us"). Contact: support@getundesk.app.
By creating an account or using the App you agree to these Terms. Our Privacy Policy explains how we handle your personal data.
Health notice. Undesk offers general wellness, stretching and mobility exercises. It is not medical advice and does not diagnose, treat or prevent any condition. Talk to a doctor or physiotherapist before starting if you have an injury, a medical condition, are pregnant, or are unsure whether exercise is safe for you. If an exercise causes sharp pain, dizziness or discomfort, stop immediately and seek professional advice.
1. The service
The App suggests short stretching and mobility routines for people who sit at a desk, including Quick Fixes for a chosen body area, daily stretches, adaptive weekly plans, body check-ins, streaks and progress summaries. Routines are generated by artificial intelligence from a curated exercise library and your inputs. We may add, change or remove features over time.
The App is provided for free, with some features available only with a paid Undesk Pro subscription (section 5).
2. Who can use the App
You must be at least 13 years old to use the App. If you live in the European Economic Area or the UK, you must be at least 16, or have the consent of a parent or guardian where local law allows. If you are under the age of majority where you live, your parent or guardian must agree to these Terms on your behalf.
3. Your account
You sign in with Apple or Google. You are responsible for keeping access to that account secure and for activity under your Undesk account. Please give accurate information during onboarding, especially about pain and injuries, as routines are tailored to it. You can delete your account at any time (see Delete Your Account).
4. Health and safety
- You use the App and perform the exercises voluntarily and at your own risk. Listen to your body and only do what feels comfortable.
- AI-generated routines may occasionally be unsuitable for you, even when based on your inputs. Use your own judgement and skip any exercise that doesn't feel right.
- The App is not a substitute for professional medical care and is not a medical device. Never ignore or delay seeking medical advice because of something in the App.
- Do not use the App while driving or in any situation where it could be unsafe.
5. Undesk Pro subscriptions
Plans and prices
Undesk Pro is offered as a monthly or annual auto-renewing subscription. Current prices, including taxes, and any free trial are shown in the App before you buy. Prices may vary by country and currency.
Purchase and billing
Subscriptions are purchased through the Apple App Store or Google Play and billed to your store account. The store's terms also apply to your purchase, and the store handles payment, billing and refunds.
Automatic renewal
Your subscription renews automatically at the end of each period at the then-current price unless you cancel at least 24 hours before the end of the current period. Your store account will be charged for renewal within 24 hours before the period ends.
Free trials
If a free trial is offered, it converts automatically into a paid subscription at the end of the trial unless you cancel at least 24 hours before it ends. Trials are available once per person.
Cancelling
You can cancel at any time in your device's subscription settings (iPhone: Settings › your name › Subscriptions; Android: Google Play › Payments & subscriptions › Subscriptions). Deleting the App or your account does not cancel a subscription. After cancelling, you keep Pro access until the end of the paid period.
Refunds
Refunds are handled by Apple or Google under their policies. Apple: reportaproblem.apple.com. Google Play: through your Play Store order history.
Price changes
We may change subscription prices. We will give you advance notice as required by the store and by law, and a price increase will apply only from your next renewal after that notice. If you don't agree, you can cancel before the new price applies.
6. Right of withdrawal (EU/UK consumers)
If you are a consumer in the EU or UK, you normally have 14 days to withdraw from a contract concluded at a distance. Undesk Pro is digital content and a digital service supplied immediately after purchase. By starting your subscription you request that we begin supplying it straight away and acknowledge that, to the extent permitted by law, you lose the right of withdrawal once supply has begun. Where the right of withdrawal still applies, you can exercise it through the store where you purchased, or by contacting us.
7. Acceptable use
You agree not to:
- use the App for any unlawful purpose or in breach of these Terms;
- copy, resell, reverse engineer or extract the App's content, exercise library or generated routines at scale, except as the law allows;
- interfere with or overload the service, bypass rate limits, security or subscription checks, or access it with bots or scrapers;
- impersonate anyone or use someone else's account without permission.
8. Intellectual property
The App, including its design, exercise library, text, graphics, sounds and software, is owned by us or our licensors and protected by law. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the App on devices you own or control, for your own non-commercial purposes, in line with these Terms and the rules of the store you downloaded it from. Routines generated for you are for your personal use.
9. Availability and changes
We work to keep the App available and reliable but cannot guarantee it will always be uninterrupted or error-free. We may perform maintenance, update the App, or change features. If we make a change that materially reduces what a paid subscription gives you, we will tell you in advance and you may cancel.
10. Suspension and termination
You can stop using the App and delete your account at any time. We may suspend or close your account if you seriously or repeatedly breach these Terms, or if required by law. Where reasonable we will tell you why first and give you a chance to fix the issue. If we discontinue the App entirely, we will give you reasonable notice.
11. Liability
Nothing in these Terms limits liability that cannot be limited by law, including liability for death or personal injury caused by our negligence, for fraud, or your statutory rights as a consumer. Subject to that:
- we are not liable for injury or loss that results from performing exercises in a way that ignores the health notice above, your own judgement or professional advice;
- we are not liable for losses that were not reasonably foreseeable, or for business losses;
- our total liability to you for any claim relating to the App is limited to the amount you paid for Undesk Pro in the 12 months before the claim.
12. Complaints
If something isn't working as it should, email support@getundesk.app describing the problem and the email address of your account. We will respond within 14 days. Consumers in Poland can also use out-of-court complaint and redress procedures, for example through the Municipal or District Consumer Ombudsman (Rzecznik Konsumentów) or the Trade Inspection (Inspekcja Handlowa). Complaints about payments and refunds are handled by Apple or Google.
13. Apple App Store and Google Play
If you downloaded the App from the Apple App Store, you also agree that:
- these Terms are between you and us, not Apple, and we, not Apple, are responsible for the App and its content;
- Apple has no obligation to provide maintenance or support for the App;
- if the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation for the App;
- Apple is not responsible for addressing any claims by you or third parties relating to the App, including product liability claims, claims that the App fails to meet legal or regulatory requirements, and consumer protection claims;
- Apple is not responsible for investigating, defending, settling or discharging any third-party claim that the App infringes intellectual property rights;
- you are not located in a country subject to a US government embargo or designated as a "terrorist supporting" country, and you are not on any US government list of prohibited or restricted parties;
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
Your use of the App must also comply with the Apple Media Services Terms or the Google Play Terms of Service, as applicable.
14. Governing law
These Terms are governed by Polish law. If you are a consumer, you keep the protection of the mandatory laws of your country of residence, and you may bring proceedings in the courts of your country of residence or in Poland.
15. Changes to these Terms
We may update these Terms, for example when we change features or when the law changes. We will post the new version here and, for significant changes, notify you in the App at least 14 days before they take effect. If you don't agree, you can stop using the App and cancel your subscription before the changes apply.
16. General
If any part of these Terms is found invalid, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not transfer your rights under these Terms without our consent; we may transfer ours to a successor operator of the App, provided your rights are not reduced.
